Copyright & DMCA policy
How to report content that infringes your copyright, and how to respond to a report.
1. Our approach
BabelStack respects the rights of creators. Users may only upload material they own or are authorized to use, as required by our Terms of Service. The Service does not publish or share users’ files: uploads and results are private to the account that created them and are deleted automatically within a few days. We respond to notices of alleged infringement under the U.S. Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512.
2. Designated agent
Send copyright notices to our designated agent:
- Agent: BabelStack Copyright Agent
- Email: support@babelstack.app, with “DMCA notice” in the subject line
3. Filing a notice
Your notice must be in writing and include:
- your physical or electronic signature;
- identification of the copyrighted work you claim has been infringed;
- identification of the material you claim is infringing, with enough information for us to locate it (for example, the account email address or job details, if known);
- your name, address, telephone number and email address;
- a statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent or the law; and
- a statement that the information in your notice is accurate and, under penalty of perjury, that you are the copyright owner or authorized to act on the owner’s behalf.
When we receive a valid notice, we remove or disable access to the material and notify the user who uploaded it. Under 17 U.S.C. § 512(f), anyone who knowingly makes a material misrepresentation in a notice or counter-notice may be liable for damages.
4. Counter-notices
If you believe material was removed by mistake or misidentification, you may send our agent a counter-notice that includes:
- your physical or electronic signature;
- identification of the material removed and where it appeared before removal;
- a statement under penalty of perjury that you have a good-faith belief the material was removed as a result of mistake or misidentification;
- your name, address and telephone number, and a statement that you consent to the jurisdiction of the federal district court for your address (or, if you are outside the United States, any judicial district in which we may be found), and that you will accept service of process from the person who filed the original notice.
We forward valid counter-notices to the original complainant. Unless they tell us within 10 business days that they have filed a court action, we may restore the material within 10 to 14 business days.
5. Repeat infringers
We terminate, in appropriate circumstances, the accounts of users who are the subject of repeated valid infringement notices, and we may prevent them from creating new accounts.
